These Terms of Service ("Terms") govern your use of Wilder, an AI-powered nature discovery app for children. Wilder is operated by Be Wilder LLC ("Be Wilder," "we," "us," "our"), a Vermont limited liability company. By creating an account or using Wilder, you agree to these Terms and our Privacy Policy.

Who Can Use Wilder
You must be at least 18 years old to create a Wilder account. By creating an account, you confirm that you are the parent or legal guardian of any child whose profile you set up under your account, and that the information you provide is accurate.

How Wilder Works
Wilder is a parent-managed app. Only parents create accounts. Child profiles live under your account; children do not have separate logins or independent accounts. You control which children use Wilder, what they see, and when they use it. You are responsible for supervising your child's outdoor activities — Wilder is a discovery tool, not a substitute for adult supervision.

Plans and Billing
Wilder offers a free tier and paid subscription tiers (Plus, Family Bundle, Premium). Current pricing is available at wilderapp.com/#pricing.
Auto-renewal: Paid subscriptions automatically renew at the end of each billing period (monthly or annual, depending on the plan you choose) at the then-current rate. We will charge the payment method on file. You can cancel anytime in your Parent Dashboard or by emailing [loading...]. We will email you a receipt at each renewal.
If we change pricing, we will give you at least 30 days' notice by email before the new price takes effect. You can cancel before that date to avoid the new rate.

Cancellation and Refunds
You may cancel your subscription at any time. Cancellation stops auto-renewal — your paid access continues through the end of your current billing period, after which your account moves to the free tier. Your child profiles and discoveries are preserved.
All Wilder paid subscriptions are non-refundable. See our Refund Policy for details and the limited exceptions required by law. We offer a free tier so you can evaluate Wilder before subscribing.

Your Content
You and your children retain all rights to photos, notes, journal entries, and observations you upload to Wilder. You grant Be Wilder a limited, non-exclusive, royalty-free license to store, process, display, and back up your content solely to operate the service for you.
We never use your photos or your children's content to train AI models. To improve speed and reduce costs, we cache identification results (for example, "this species was identified in this region") so that common identifications can be served faster without re-sending images to third-party AI services. Your actual photos remain private to your account and are not shared between users. You can delete content from your Parent Dashboard at any time. Photos are removed from active systems immediately and from backups within 30 days.

AI Identification — Important Safety Notice
Wilder uses AI to help identify plants, animals, insects, fungi, tracks, and other natural finds. AI identifications can be wrong.
Never eat, touch, or handle anything based solely on a Wilder identification. This is especially critical for mushrooms, berries, plants that resemble edible varieties, and animals including snakes and spiders. Always verify with a qualified expert, field guide, or trusted local resource before consuming or handling any wild plant, fungus, or animal. Wilder is for educational and exploratory purposes only and is not a substitute for expert identification, foraging guidance, or medical advice.

Acceptable Use
You agree not to:
- Upload illegal, harmful, harassing, or infringing content
- Attempt to access other users' accounts or our systems without authorization
- Scrape, reverse engineer, or attempt to extract source code or data
- Resell, sublicense, or use Wilder for commercial purposes without our written permission
- Interfere with or disrupt the service
We may suspend or terminate accounts that violate these Terms.

Children's Privacy
Our handling of children's information is governed by our Privacy Policy and complies with the Children's Online Privacy Protection Act (COPPA). When you create an account and complete the in-app consent disclosures, you provide verifiable parental consent for the data practices we describe. You can review, export, or delete your child's information at any time from your Parent Dashboard.

Service Availability
We work hard to keep Wilder available and reliable, but we don't guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice. If we discontinue a paid feature you have prepaid for, we will refund the prorated unused portion.

Intellectual Property
Wilder, the Wilder name and logo, the app's design, and all related materials are owned by Be Wilder LLC and protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from these materials without our written permission.

Disclaimers
Wilder is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that AI identifications will be accurate, that the service will be error-free or uninterrupted, or that it will meet your specific needs. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability
To the fullest extent permitted by law, Be Wilder LLC's total liability to you for any claim arising out of or relating to these Terms or your use of Wilder is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill, even if we were advised of the possibility. Some jurisdictions do not allow these limitations — they may not apply to you.

Indemnification
You agree to defend, indemnify, and hold harmless Be Wilder LLC and its officers, members, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the service, or your violation of any law or third-party right.

Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Vermont, without regard to its conflict-of-law principles. For any dispute you cannot resolve with us informally, you agree to bring claims exclusively in the state or federal courts located in Vermont. Small claims court is always an available option for qualifying disputes.

Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify you by email at least 30 days before they take effect. Your continued use of Wilder after the effective date means you accept the updated Terms. If you do not agree, you may cancel your subscription before the new Terms take effect.

Termination
You can close your account at any time from your Parent Dashboard. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users or our service. On termination, sections of these Terms that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.

Miscellaneous
These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and Be Wilder LLC about your use of Wilder. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
